Yes, the Underground Utility Damage Prevention Act is enforced by the Underground Utility Damage Enforcement Board. If you are found in violation of the law, you could be ordered to training and/or face a monetary penalty up to $15,000.
Can utilities get in trouble for not meeting their obligations under the law?
Yes, the same penalty structure that applies to excavators can be applied to utility operators.
How do I notify the enforcement board that a violation has occurred?
Violations should be reported online through the Tennessee Public Utility Commission, who provides administrative support to the enforcement board. Use the “Online Damage Prevention Complaint Form” at www.tn.gov/tpuc.
